In most states, and employer must give a final check within 24-72 hours after termination. Thus, he should get his check within the proscribed time frame. How much should he get paid? Based on your description, it appears that he does not earn the commission until the client has paid. Thus, if he quits before some of his clients pay, then he has quit before he has earned the commission.
