Yes he does but after your cleared to work "look out" They can have a lay off and bring everybody else back but you ( thats what happened to me) and that is legal too....

Not necessarily. There duty is to usually just reasonably accommodate you. If you are out for a short period and have a fungible job, then reasonable may mean to keep it open for you. However, if it is uncertain when you will be back and/or you have a highly skilled position which cannot be filled with a temp, then they most likely don't have to hold your job.

It varies by state, but if they cannot accommodate modified duty, and/or your doc took you off work completely, the employer cannot fire you. They also do not have to hold your job. That means that they can give you another position which may be similar to your pre-injury position. But no, they cannot fire you.
