  • I'm pretty sure they can. They are her family, and she was not married. I doubt there is any way to stop them.
  • Yes , unless she was married , I'm so sorry for your loss that is so sad + 5
  • Her next of kin has the right to move the body. Based on what you said in your question, it would appear that her family is the next of kin.
  • Thank you to all who took the time to answer. I have accepted the fact that there is not very much I can do about the situation. Since we never had the opportunity to marry I have no legal rights to prevent her parents from taking her wherever they want. I find it kind of strange that they would wait almost 3 years to do this. I think it is being done to me out of spite because her dad hates me and never has acceoted the fact that his daughter was with me of her own free will. I have a feeling this is payback because they think the district attorney is going to reopen the case against the 3 men who raped and beat her. They were already charged with a lesser crime and are serving time right now but are due for a parole review in a couple of years. Her family believes that the DA can retry the case on the capital murder charges they shoul;d have been charged with to beging with. I have refused to participate in their hopeless attempt to get the case reopened and I think this is thier way of retaliating against me for not being willing to cooperate. I appriciate all your time and kind words. I guess I am going to have to acceopt the fact that they hold all the cards since they are her family and I am nothing.
  • this is the most hurtful thing i have heard in a good long time. i think she should be allowed to "rest in peace". this would be very expensive and emotionally disturbing on so many levels. if they had desires of different burial site, they should have spoken up over 2 years ago upon her death they techically don't visit her, she is dead. depending upon their beliefs, she is in heaven or is not existing anywhere.
  • my heart goes out to you.my ex's brother was killed in an auto accident.my ex's family wanted him buried w/the rest of his family, but his wife(control freak)would have nothing doing she had him buried where she wanted.150 mi from his family.3 yrs later she's remarried and moved 750 mi away.......
  • My heart goes out to you buddy. You honor your girl by being the man you are.I am sure she is very proud of you.May God give you strength.
  • Awwwww sweetguy!!! I am so sorry that this has happened! They're being jerks and need to accept the fact that she loved you... They should see that you truly loved her and it would be completely senseless to move her after she has already been buried... It's not fair to you and I personally feel that it is disrespectful to their daughter... You are such a sweet guy and you deserve way better treatment than that!!! My biggest hugs for you, my dear friend and virtual dad!
  • Sorry Bud But you done all you could for her and you do need closeure of her death as well as you do have to start a new life,She can never come back but you will have the satisfaction that you did have her near you for thoses years. It's ok to love her but let her go. She's with angels now. Her parents I'm sure is quite upset as well and maybe it will be nice for them to finially take her home, and it will maybe be a closeure for them as well. It's time for all of you to love her but let her go.So young ,so sad but I'm sure you have wonderful memories of her and that's all you need to know you were that special person in her life, No one can ever take that from you...So sorry again [HUGS]
  • Yes, they have the rights to move their daughter. Anyone who is the next of kin has the right to move a corpse from one place to the other after filing the proper paper work and paying the fees required to do so. Leaving no will generally equals the estate goes to the deceased parents if there is not a spouse or a child of legal age to manage the estate. It is always best of have a will at any age as being old is not a requirement to die.
  • Not without a court order and documentation of their appointment executrix or executor of the estate then if no will sisters and brothers have the first right as interested parties. You can go to court and file papers as an interested party and take it before the court where you are. Good Luck ~Sister Rock
