  • You are either in an association legally or not. There is no in betweens. The governing documents run with the land and are attached to your warranty deed at the time when it was recorded. If your warranty deed lacks these documents then I would have to say that you are not tied to the association. Legally if you do not pay your assessments a lien will be placed on your home until that lien is satisfied. If you have not experienced this then that might be some implication that you are not tied to the association.   • If membership is optional, then they have no claim on your property. If you have any question of their transparency, stay away, or face years of frustration.
