If the student was receiving or making text messages during class, then the teacher was doing what he should have done. And the student should learn his or her lesson, in both senses, and not complain.

First off, I sincerely hope you're not the student. That there is some good English. Second, you're in a class room. Put the damn phone down. And, yes it is legal.
