It depends on where you are, to a large degree. In the U.S., divorce law is a state matter and your state has it's own laws. In California, anything that happens before the date of separation is part of "community property", so if the accident occurred before you were separated any award might be considered community property subject to division. Talk to your lawyer.

In my state he would be. It's joint property until it's signed by the judge. He, or you, can change their mind at any time up to that point.
