  • Ask your Realtor about the validity. In my State it is not the least bit out of the ordinary to email or FAX offers -- once fully executed, they are legally binding contracts. If the buyer(s) fail to perform according to the terms of the contract, you can retail the earnest money as liquidated damages and MAY have other options. Good luck. In this market it can take months to obtain financing, and even longer to come up with another qualified buyer. I would recommend that my client keep the earnest money are relist the property.
