In order to give a correct answer, is the fence wood or metal? a metal chain link fence is permissible, as long as the fence is within the boundary line of the owners property. check with your local codes department, but generally fences can be no taller than 4 feet. A wooden fence has to also be within the boundary line of the owners property. the smooth side of the fence should be facing the outside or toward your neighbor.

It is a wood fence, no matter if the smooth fence is on either side. The neighbor feels that he owns the fence. If it is a common fence, the way that it was explained to us when we bought the home as long as it conformed to the Home Owners Association approval, which was granted, we could stain the fence to match our backyard fence. In other words, because it does face our side, we could stain it to match. Our neighbor disagrees as he thinks he owns the fence and does not feel that we have any say so. Contacted the Pres. of the Homeowners association and his answer is totally disatisfactory. He claims that no plan was submitted and has asked the neighbor to fax him a copy of the plan. What plan, the contractors. Is this what we have to do?
