  • Yes. I believe so. The government gets away with it by claiming that the second hand smoke makes for an unhealthy work environment. I say that if the place is a smoking establishment when the cook or waiter took the job, then they agreed to that risk. When they feel that the smoking environment is detrimental to their health, then they can find employment elsewhere if they wish.
  • You know, I really don't think so. How hard is it to walk 10 feet and smoke outside? It doesn't make the place smell, non smokers can enjoy the atmosphere, and employees aren't forced to inhale second hand smoke.
  • No. Having suffered extreme allergic reactions to second-hand smoke, I have found the smoking ban in force where I live to be a godsend. I can now patronize businesses that I never could before. Without a ban, I would never be able to eat in a restaurant, have a beer in a bar or even buy a magazine (ALL of the newsstands in this area were smoking establishments pre-ban) without suffering serious problems.
