Can the hospital really tie up probate and get paid before the relatives from a will?
Is this true? I was just told (and googled it/and it seems to be true) that the Hospital can place a lien against a deceased person’s estate for unpaid medical bills? Can the hospital really tie up probate and get paid before the relatives from a will? My Mom was visiting my out of State brother. She recently fell off a bicycle, and her complications have grown and become worse. It is very scary. She is still in the hospital in serious condition. The hospital does not accept her insurance and I am freaking out. What can I do? Can the hospital release her to another hospital that would hopefully take her insurance? What if she dies, then what do we do about her medical bills?

Creditors have a specific time to file claims against the estate (usually a year). If the executor opposes the creditor's claim, the matter would go into a probate court where the judge's determination is final.
