  • I don't know about Texas, but here in Virginia it sure is. And there's no getting over the awkwardness of having someone hover over you like a hormonally challenged female prison warden while you do your damnedest to pee into a cup that seems to shrink by half as soon as you try and squat over it.

  • Not in Florida where I live and this is a pretty regressive state as far as it's employee laws and it is not lawful in this state to do so, hence it can't be lawful anywhere else and Texas is a closest to first but not by much.
  • They didn't watch me in California (employer), instead they also tested it for body temperature.
  • For employment, I highly doubt it. I worked in a lab in Arizona and done drug tests, the only people we were allowed to observe were court appointed. Anyone else and we had to stand outside the door keeping a ear out.

  • Yes. With the exception of crime related drug testing, a urine test is 100% voluntary. It would be illegal for an employer to force you to take a urine test (or to do anything else for that matter) in front of another. However, there is no problem if you consent to the test. Is a drug test really voluntary? It is. You have every right to refuse to take a drug test, and there is nothing an employer can do to force you to take a test. Of course, the employer has the right to not hire you as well.
  • I have had test and the bathroom has the water turned off and the toilet water is blue and they check the temp of the sample. in other words setps are taken to ensure it is your sample. This is a very odd instance. Was it for work? was it done at work? Usually an employeer won't do this in house because of contamination liability.
