  • First, the gun-holder, will be arrested, simply because he is in possession of the possible murder weapon. the police will take him in for questioning. this is the time that person can prove or disprove his guilt or innocence. the police will verify his information and run a background check and warrants. After further investigation, if the person with the steaming gun cannot be directly tied to the dead person or their is not other evidence to substantiate a formal charge on this person, the police will let him go. Is all about burden of proof and to protect the innocent.
  • Check for gunpowder residue on his hands. When it is fired it should leave evidence on the hands of the person who fired it. If they bother to believe you enough to check that out.
  • Since the gun was steaming and in his hand he most likely is the one who fired it.
