  • Depnding on age. If both are adults and they have lived together for long enough to be common law married as fiance then she would get the remaining payment and the car. If they were shortly fianced and not living together then the family wiould have acess by rights of survivorship.
  • Not all states recognize common-law marriage. There is no statement in the question that they were living together. The car, being in the decedent's name, would be a part of his estate. Unless there is a will providing differently, the fiancee has no claim on the car or anything else belonging to the decedent.
