• If there are five heirs, which heir was willed the house? that heir will have to evict the current renters. a 30-day written eviction notice, from your local sheriff dept., will be sufficient. why was the house rented, without a lease, in the beginning? i can see no problem with the eviction. if there is one, consult an attorney. remember, if there was a verbal agreement between your mom and the renters, it is not binding now, unless the agreement was heard by a third, uninterested party. it may have been an understanding then, but it is not legal now.
