  • In terms of the mortgage contract, if the mortgage is only in your wifes name then you don't have to pay. But if you stop paying and the bank forcloses you could lose all the money you put into the house. However, if you had a separate contract with your wife, then you would still be liable to her. I am not sure what state you are in, but if your state has a legal separation requirement (and you are a community property state), you should do it ASAP. Otherwise, all that money you are paying now will be split 50/50 with your wife.
