You need to talk to a lawyer. People separate all the time but it sounds like this is not a mutual decision. A legal separation (by the way we are not talking about domestic violence/restraining order issues here, are we?) is a contractual agreement. You each have rights and duties as a married couple and to prevent future problems see a law professional.

If a couple is married, both have legal rights to the residence, until a final divorce decree. Seeking a writ of eviction will not work, since 50% of the house belongs to him. the writ should not be issued. Best, for one or the other spouse to leave, until the divorce is final.

You can't MAKE him leave unless there are some sort of violence charges. Get a lawyer, either way, see what he/she can do.

Talk to a lawyer: Most will give a free consult prior to hiring them. If not, there are woman's groups you might contact--try NOW, or other women's group. In the meantime--try to stay calm and very non-argumentative.

To be legally separated, it simply means you no longer live with them. Getting a divorce would be the next step. If you want them forcefully removed, I would get a restraining order.
