  • You need to talk to a lawyer. People separate all the time but it sounds like this is not a mutual decision. A legal separation (by the way we are not talking about domestic violence/restraining order issues here, are we?) is a contractual agreement. You each have rights and duties as a married couple and to prevent future problems see a law professional.
  • If a couple is married, both have legal rights to the residence, until a final divorce decree. Seeking a writ of eviction will not work, since 50% of the house belongs to him. the writ should not be issued. Best, for one or the other spouse to leave, until the divorce is final.
  • You can't MAKE him leave unless there are some sort of violence charges. Get a lawyer, either way, see what he/she can do.
  • Talk to a lawyer: Most will give a free consult prior to hiring them. If not, there are woman's groups you might contact--try NOW, or other women's group. In the meantime--try to stay calm and very non-argumentative.

  • To be legally separated, it simply means you no longer live with them. Getting a divorce would be the next step. If you want them forcefully removed, I would get a restraining order.
