  • Federal law governs this, but it can also be more specific with state guidelines too. No employer can make any deduction or withhold an employee’s wages without voluntary written authorization to do so. They need to be paid their rightful wages on the normal payday. I would caution you, if they become angry and call a lawyer it can make your life miserable. You will have your payroll records subpoenaed and it may not even be an issue with this employee but another, and then you will be fined.

  • You have to give him his check tomorrow for that pay period, he'll wait two weeks if you want for the remainder worked passed that pay period. You only have 24 hours to pay a person if you laid off/fired them!
  • why would you hold his check. it is his money would you have given him a two weeks notice if you were to fire him. no CONSIDER YOUR SELF FIRED AS HIS EMPLOYER
  • Just give him the check. What you may gain in revenge you lose in giving a poor impression of your management style to your remaining employees.

  • Your attitude shows why they quit. You obviously couldn't be trusted with 2 weeks notice. If this wasn't true, you would already have paid them and wished them well in their new position. They are obviously going to a better position, more pay, a better boss, or some other thing that made the new job more desireable. Stop being such a selfish jerk. Give them their money and learn how to treat your employees fairly!

  • Actually, He quit on me. I didn't fire him. And I'm losing over 1000 dollars because of him quitting. It's a 2 man crew, and I have no one to work this week. And by law, I can hold his check until the end of the 2 weeks. Thanks.

  • I know here if they quit you can hold it 30 days. If you fire them you have to pay them then!
  • I wish people will actually answer the questions to there own questions. Why would you want to keep his pay? Yes he might have inconvenienced you, but 2 wrongs doesn't make it right. We also don't know why he left. I do think it is disgusting to not work your probation period as you put someone else in a difficult position, but he worked for his money and deserves it. He might need that money to feed his family. As a business owner myself I do understand how you feel, but don't hold grudges and poison your soul.
